Roots of President Obama’s Financial Reform

ウォール・ストリートの大手金融機関ゴールドマン・サックスは、2008年に住宅市場崩壊の原因となったリスクの高いサブプライム・ローン問題で、金融の安全性に関し、証券取引法違反(詐欺罪)であるとして起訴された。

Goldman Sachs, the large financial company of Wall Street, was indicted for its violations of Financial Instruments and Exchange Law, not disclosing the risk of mortgage backed financial securities. This was one of the direct causes of the collapse of housing market due to subprime lending in 2008.

これに関連し、2010年オバマ大統領は、金融業界の透明性を強化する為、金融改革政策の展望について公表した。正しい方向への一歩を踏み出したとしてこれを肯定的に評価する声と、具体性に欠ける改革案だとして批判する声が挙がった。

In response to this event, in 2010, President Obama publicly talked about his perspective of a financial reform aiming toward enforcing transparency in financial institutions. Some proponents of Obama’s financial reform said; it was a first step in the right direction. Some critics said the plan lacked some details.

1930年代の世界経済恐慌の第一の原因は、株式市場が崩壊した1929 年10月から始まり、数ヶ月以内に全ての株主が多額の損失をうけ、金融機能不全に陥ったことである。1930 年代は約9,000の銀行が倒産し、預金者はお金を失った。

A primary cause of the great depression in the 1930s was that global financial markets crashed beginning in October, 1929, creating huge losses for stockholders within a few months and led banks to fail in the 1930s. During the period, about 9,000 banks failed and depositors had lost their money.

1933年、フランクリン・ ルーズベルト大統領はこのような金融システムの崩壊に対処するため、金融業界の透明性を強化する金融改革法案を打ち出し、グラス・スティーガル法を制定した。銀行の無責任な投機又はスペキュレーションの取り締まりを強化したこの法は、政府に多大な権限を与えた。また、連邦預金保険公社(FDIC)を設立することにより、商業銀行と投資銀行を分離し、銀行が倒産しても預金者が預けたお金の回収を可能にすることを目指した。数年後、議会は主な金融規定法を通過させた。

In 1933, Franklin Roosevelt set up a series of banking reforms in order to cope with the failure of the financial system and emphasized the need for transparency in the financial system. His banking reform, called the Glass-Steagall Act, which gave regulatory power to the government, was passed to end irresponsible speculation by financial institutions. The law separated commercial banking and investment banking, and it also established the Federal Deposit Insurance Commission (FDIC) which was designed to insure the money of depositors in case of bankruptcy of banking institutions. A few years later, Congress passed other major financial regulations.

複雑なアメリカの金融システムとその歴史を簡略的に考察すると、オバマ大統領の金融改革には、このような歴史的ルーツをみることができる。ルーズベルト の連邦金融法は、歴史的には一部が改正されたり、廃止になったりしている。近年では1980年代から2008年までは、グラス・スティーガル法は廃止されていたが、オバマ大統領はこの法律の根本精神を再度呼び起こそうとしている点が注目される。

Although these are simple explanations, Obama’s recent financial reform plan can be similar to the Roosevelt’s Glass-Steagall Act of 1933 which has been recently repealed. In recent years, since 1980s to 2008, the Glass-Steagall Act was effectively repealed by modification at different times, but President Obama seems to intend to recall the fundamental spirit of the Steagall Act by reinstating it.

オバマ大統領の金融改革のポイントを整理すると、経済不況から脱却するためには納税者と銀行の双方を保護する一連の改革が必要になるということである。その為には、消費者を保護するための新たな連邦準備機関を設置し、大規模な金融企業が倒産した場合、市場に不慮の損失を与えないよう、このような金融機関を清算する権言を政府に与えるという趣旨である。

Obama’s financial reforms are designed to protect both taxpayers and banks in order to recover from the current recession. The new laws would establish a Federal Reserve agency to protect consumers, and give authority to liquidate large financial firms so they don’t cause collateral damage to the markets if they were to collapse.

自由市場の重要性を強調しながらも、リスクを意に介さない金融業界の無謀性には規制を加える必要があることをほのめかしている。大半のアメリカ国民はこのような金融規制には同意するという印象も受けている。

While emphasizing the importance of free markets, Obama implies the necessity of regulation to eliminate reckless risk-taking by financial businesses. My impression is that the majority of the American people support this kind of regulation.
