The United States Constitution was drafted by 55 delegates who gathered at Independence Hall in Philadelphia in 1787. Thomas Jefferson referred to the Constitutional Convention as “an assembly of demigods.” Historians describe these delegates as brilliant young men who would go on to shape the future of the United States. Following the Declaration of Independence in 1776, the thirteen states—with the exception of Rhode Island—sent most outstanding and legally experienced individuals to the Constitutional Convention.

The person who played the primary role in writing the Constitution was Gouverneur Morris (1751–1836)—a New York lawyer, politician, and diplomat known as the “Penman of the Constitution.” At the convention, he provided significant assistance to James Madison (1751–1836) of Virginia, who managed debates among the delegates and proposed points of compromise. In drafting the document, they placed great emphasis on the separation of powers—the fundamental constitutional principle of checks and balances among the legislative (Congress), executive (President), and judicial (Courts) branches. While Morris penned the actual draft, Madison exerted a profound influence on the document’s wording and overall formulation. The original Constitution is preserved at the National Archives Building in Washington, D.C.

Additionally, the U.S. Bill of Rights was added to the Constitution. Ratified on December 15, 1791, the Bill of Rights consists of the first ten amendments to the U.S. Constitution (1787) and is designed to guarantee individual liberties. The First Amendment—covering freedoms of religion, speech, the press, and peaceful assembly—is the one most frequently cited by U.S. citizens. The Second Amendment guarantees the right to bear arms. The Third Amendment prohibits the quartering of soldiers on private property without the owner’s consent during peacetime. The Fourth Amendment prohibits unreasonable searches and seizures.

The Fifth Amendment protects the right to refuse to testify (against oneself). The Sixth Amendment guarantees the right to a fair trial for individuals accused of crimes. The Seventh Amendment guarantees the right to a trial by jury. The Eighth Amendment prohibits excessive bail, excessive fines, and cruel and unusual punishment. The Ninth Amendment—often unfamiliar to many Americans—stipulates that the fact that certain rights are not explicitly listed in the Constitution does not mean the people do not possess them. The Tenth Amendment limits the powers of the federal government to those granted by the Constitution. The U.S. Constitution, originally adopted in 1788, was thus amended to include these ten articles known as the Bill of Rights.

For 250 years, U.S. presidents have upheld the spirit of the Constitution as envisioned by the Founding Fathers. However, in the first half of this year, an extraordinary number of legal scholars sounded the alarm regarding a constitutional crisis. According to a statement published on February 26 by the American Constitution Society, more than 1,000 legal scholars nationwide signed a bipartisan letter condemning a series of unlawful executive orders and actions by President Trump. The letter states: “We believe we are currently in a constitutional crisis. While we hold diverse views on the specific policies in question, we are united in the conviction that the President’s actions are unlawful and unconstitutional. We regret the need to explain the fundamental principles of democracy to the President, yet we feel compelled to do so. Beyond the obligation to uphold the Constitution, the President is bound to obey court orders enjoining his unlawful and unconstitutional actions. The law is not whatever Mr. Trump says it is; he is not a king. We stand for democracy and the rule of law, and we stand with the individuals and organizations targeted by unlawful and unconstitutional exercises of power.”

In addition to major media outlets such as The New York Times, The Washington Post, and the Associated Press, legal organizations—including the Civil Rights Litigation Clearinghouse, Court Watch, Just Security, and Lawfare—are tracking the legal cases involving President Trump. As of January 16, 2026, the Associated Press was tracking 359 cases, categorized into 14 groups. According to records from Just Security released on October 8, 2026, the total number of cases being tracked across various categorized breakdowns stood at 975 as of January 29, 2025. This situation clearly illustrates why approximately 1,000 legal scholars have described the circumstances as a constitutional crisis.
